General Terms and Conditions

§ 1 Scope, Customer Information, and Basis of Contract

(1) These General Terms and Conditions apply to all purchase agreements between AV Nice Pools GmbH and consumers at the time of ordering, unless expressly agreed otherwise in writing. The contract language is German.
(2) A consumer is any natural person conducting a legal transaction not related to their commercial or self-employed professional activities (§ 13 BGB).
(3) By signing the purchase contract, the consumer acknowledges the following General Terms and Conditions as an integral part of the agreement.
(4) All agreements must be made in writing.

§ 2 Formation of Contract and Right of Withdrawal

(1) Contracts are concluded with:

(2) Consumers have the right to withdraw from the contract under specific circumstances, such as contracts concluded outside AV Nice Pools GmbH’s business premises.

§ 3 Scope of Services by AV Nice Pools GmbH

Unless otherwise agreed in writing, the following services are not included in the contract:

• Delivery to the destination,
• Construction and ground preparation,
• Crane, excavation, and concrete work,
• Installation at the destination,
• Connection of water, electricity, and heating.

The customer is responsible for these services and any additional costs incurred.

§ 4 Prices and Payment

(1) Prices are based on current price lists.
(2) All prices are ex-factory, excluding packaging and shipping.
(3) Payment can be made via advance payment, PayPal, or credit card (Visa, Mastercard, American Express).

§ 5 Liability

AV Nice Pools GmbH is not liable for defects resulting from improper execution of services by the customer.

§ 6 Retention of Title

Goods remain the property of AV Nice Pools GmbH until full payment is made.

§ 7 Final Provisions

German law applies to all contracts with AV Nice Pools GmbH. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
